Acceptable Use Policy

This Acceptable Use Policy (the “AUP”), as may be amended, restated, supplemented, or otherwise modified from time to time, sets out, in general and non-exhaustive terms, conduct that is prohibited in connection with the access to and use of the websites, applications, and services made available by or on behalf of BitVault Europe S.A. LTD. (“BitVault”, “we”, “us”, or “our”) from time to time (the “Services”). This AUP forms part of, supplements, and is incorporated by reference into our Terms of Service; capitalised terms used and not otherwise defined herein bear the meanings given to them therein. Any contravention or apparent contravention of this AUP may result, without limitation, in the restriction, suspension, or termination of your account, the reversal or refusal of transactions, and, where BitVault considers it appropriate or is required, the referral of the matter to law-enforcement, regulatory, or other competent authorities, in each case without prejudice to any other right or remedy available to BitVault.
1. General Principle
The Services may be accessed and used only for lawful purposes, in a manner consistent with these Terms, this AUP, all applicable laws and regulations, and the rights of BitVault and of third parties. The enumerations of prohibited conduct set out below are illustrative only and shall not be construed as limiting the generality of the foregoing principle; BitVault may treat as a contravention of this AUP any conduct which, in its reasonable assessment, is inconsistent with that principle, whether or not expressly enumerated herein.
2. Prohibited Activities
You shall not, and shall not attempt to, and shall not knowingly permit, procure, assist, or facilitate any third party to, use the Services to:
- engage in, facilitate, or conceal money laundering, terrorist financing, fraud, corruption, market abuse, tax evasion, or any other unlawful, deceptive, or improper activity, howsoever arising;
- deal, in whole or in part, in assets that are derived, directly or indirectly, from criminal conduct, or that you do not lawfully own or control, or in respect of which any third party holds rights inconsistent with such dealing;
- evade, avoid, or circumvent, or seek to evade, avoid, or circumvent, any sanctions, embargoes, or restrictive measures, or transact, directly or indirectly, with or for the benefit of any sanctioned person or any person located in or connected with a prohibited jurisdiction;
- infringe, misappropriate, or otherwise violate the intellectual-property, privacy, publicity, or other rights of any person; or
- transmit or distribute malicious code of any description, conduct phishing or social-engineering campaigns, impersonate any person or entity, or otherwise deceive, defraud, harass, or harm any user or third party.
3. Platform Integrity
You shall not, and shall not attempt to:
- obtain unauthorised access to, or make unauthorised use of, any account, system, network, or data, whether belonging to BitVault, to another user, or to any third party;
- probe, scan, test, or assess the vulnerability, configuration, or security posture of the Services or of any related system, save with the prior written consent of BitVault;
- interfere with, disrupt, degrade, or impose a disproportionate burden upon the Services or any related infrastructure, whether by means of denial-of-service activity, automated scraping or harvesting, or otherwise;
- circumvent, disable, or render less effective any rate limit, authentication mechanism, security control, or usage restriction forming part of the Services; or
- reverse engineer, decompile, disassemble, or otherwise seek to derive the source code of any component of the Services, save to the extent such restriction is prohibited by applicable law.
4. Fair & Reasonable Use
The Services are made available for lawful personal and business use of a reasonable and proportionate character. BitVault may, at any time and from time to time, determine that any usage pattern, including excessive, abusive, or anomalous automated activity, or any usage imposing an unreasonable load upon its infrastructure, is inconsistent with fair and reasonable use, and may restrict, throttle, or otherwise manage such usage by such means as it considers appropriate.
5. Responsible Disclosure
BitVault welcomes security research conducted in good faith and in accordance with applicable law. Should you become aware of any actual or suspected vulnerability affecting the Services, you are requested to report it, in confidence and without undue delay, to security@bitvaultapp.net, to refrain from any public or third-party disclosure until BitVault has had a reasonable opportunity to investigate and remediate, and to refrain in all circumstances from accessing, modifying, copying, or retaining data belonging to BitVault or to any other person beyond the minimum strictly necessary to demonstrate the matter reported.
6. Monitoring & Enforcement
BitVault may, but shall not be obliged to, monitor use of the Services for the purposes of ascertaining compliance with this AUP, and may investigate any suspected or alleged contravention by such means as it considers appropriate. Upon any contravention or apparent contravention, BitVault may take such action as it considers appropriate in the circumstances, including, without limitation, the issuing of warnings, the removal or disabling of content, the restriction of features or functionality, the suspension or termination of accounts, the withholding, reversal, or refusal of transactions, and cooperation with law-enforcement, regulatory, and other competent authorities, in each case without prior notice where BitVault considers such action necessary or where notice would be unlawful or inappropriate, and without liability to any person, to the fullest extent permissible under applicable law.
7. Reservation of Rights
No failure, delay, or forbearance by BitVault in enforcing any provision of this AUP shall constitute a waiver of that or any other provision, nor shall any single or partial exercise of any right preclude any further exercise thereof. The rights and remedies of BitVault under this AUP are cumulative and are in addition to, and not in substitution for, any rights and remedies available under the Terms of Service or at law.
